Utah Resident Privacy Notice

This Utah Resident Privacy Notice (“Utah Notice”) provided by the fitness centers (“Fitness Centers” or “we” or “our”) owned or operated by Premise Health Employer Solutions, LLC (“Premise Health”) supplements the information contained in our Fitness Center – Privacy Policy (“Privacy Policy” or “Policy”) and our Fitness Center – State Law Addendum (“Addendum”).

If you are a Utah resident that visits the Fitness Centers, the information below may apply to you.  This Utah Notice describes consumer rights under the Utah Consumer Privacy Act (“UCPA”) and explains how to exercise those rights.  The UCPA protects information that is linked to or is reasonably linkable to an identified or identifiable individual (“Personal Data”).  Personal Data does not include information that is de-identified, aggregated data or publicly available.

The UCPA and this Utah Notice do not apply to Member health information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”).  That information is governed by the Notice of Privacy Practices, which is available at the Privacy & Compliance Policy Center.  The UCPA excludes other categories of information that we do not list here.

Any terms defined in the UCPA have the same meaning when used in this Utah Notice.  To the extent there is any inconsistency between the Privacy Policy and this Utah Notice, the terms of this Utah Notice apply.

Personal Data We Collect, Use and/or Disclose

The categories of Personal Data we may collect, how we may use that Personal Data and the categories of third parties to whom we may disclose/share that Personal Data, is included in our Privacy Policy.  We may collect Personal Data from a child but only if the child is eligible for Fitness Center services and with parent permission.

As noted in our Privacy Policy, we may collect this Personal Data directly from you or our clients (e.g., employers).

We do not:

  • collect (i) Personal Data revealing racial or ethnic origin, religious beliefs, sexual orientation, citizenship or immigration status; (ii) genetic or biometric data for the purpose of identifying a specific individual; or (iii) specific geolocation;
  • sell Personal Data; or
  • engage in targeted advertising.

Your Right to Know

You have the right to know whether we are processing your Personal Data.

Your Right to Access

You have the right to access and obtain a copy of the specific pieces of Personal Data we have collected about you, upon verification of your identity.

Your Right to Correct

You have the right to request that we correct inaccurate Personal Data that we collected and maintain about you.

Your Right to Request Deletion

You have the right to request that we delete the Personal Data that we collected from or obtained about you, subject to certain exceptions under the law.  Once we receive and confirm your identity, we will delete (and direct our service providers to delete) your Personal Data from our records, unless an exception applies.

Your Right to Opt Out

You have the right to opt out of certain sharing of your Personal Data.

Your Right Not to Receive Discriminating Treatment

You have the right not to receive discriminatory treatment for exercising any consumer rights described in this Utah Notice or the UCPA.

How to Exercise Your Rights

We may ask you to provide additional Personal Data, such as your name and email, so that we can properly identify you in our dataset to track compliance with a request. We will only use Personal Data provided in a request to review and comply with the request. If you choose not to provide this information, we may not be able to respond to your request if we cannot verify your identity (or your authority to make the request for someone else). In certain circumstances, we may decline a request to exercise the rights described above.

You may designate an authorized agent to exercise your rights on your behalf.

Our Response

We will try to respond to a verifiable consumer request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email.  Information provided in response to a consumer request will be provided free of charge once in a twelve (12)-month period.

However, we may charge a reasonable fee to cover the administrative costs of complying with a request or refuse to act on a request, if: (A) the request is excessive, repetitive, technically infeasible, or manifestly unfounded; (B) we reasonably believe the primary purpose in submitting the request was something other than exercising a right; or (C) the request, individually or as part of an organized effort, harasses, disrupts, or imposes undue burden on the resources of our business.  If we determine the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply within forty-five (45) days of receiving the request.
