California Resident Privacy Notice

This California Resident Privacy Notice aka Notice of Collection (“California Notice”) provided by the fitness centers (“Fitness Centers” or “we” or “our”) owned or operated by Premise Health Employer Solutions, LLC (“Premise Health”) supplements the information contained in our Fitness Center – Privacy Policy (“Privacy Policy” or “Policy”) and our Fitness Center – State Privacy Law Addendum (“Addendum”).
If you are a California resident that visits the Fitness Centers, the information below may apply to you. This California Notice describes consumer rights under the California Consumer Privacy Act and its implementing regulations (“CCPA”) and explains how to exercise those rights. The CCPA protects information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to, directly or indirectly, a particular consumer or household (“Personal Information”). Personal Information does not include (i) consumer information that is deidentified; (ii) aggregate consumer information; (iii) publicly available information; or (iv) lawfully obtained, truthful information that is a matter of public concern.
The CCPA and this California Notice do not apply to Member health information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”) and/or the California Confidentiality of Medical Information Act (“CMIA”). That information is governed by the Notice of Privacy Practices, which is available at the Privacy & Compliance Policy Center. The CCPA excludes other categories of information that we do not list here.
Personal Information relating to job applicants and employees is governed by our California Job Applicant Privacy Notice and Personnel Privacy Notice.
Any terms defined in the CCPA have the same meaning when used in this California Notice. To the extent there is any inconsistency between the Privacy Policy and this California Notice, the terms of this California Notice apply.
Personal Information We May Have Collected, Used and/or Disclosed In The Last 12 Months
In the last 12 months, we may have collected categories of Personal Information set out in the Privacy Policy.
- As noted in our Privacy Policy, we may have collected this Personal Information from a child but only if the child is eligible for Fitness Center services and with parent permission.
- As noted in our Privacy Policy, we may have collected this Personal Information directly from you or our clients (e.g., employers).
In the last 12 months, we may have used this Personal Information for the business and/or commercial purposes set forth in the Privacy Policy.
In the last 12 months, we may have disclosed this Personal Information in the ways noted in the Privacy Policy.
WE DO NOT SELL OR SHARE PERSONAL INFORMATION, AND WE HAVE NOT SOLD OR SHARED PERSONAL INFORMATION IN THE LAST TWELVE (12) MONTHS
How We Retain Your Personal Information
We will retain your Personal Information in accordance with Premise Health’s record retention requirements and policies which reflect business and legal considerations. Premise Health will retain your Personal Information for the time period reasonably necessary to achieve the business and commercial purposes described in the Privacy Policy and this California Notice or any other notice provided at the time of collection. Your Personal Information may be retained longer if required or permitted by applicable law.
Your Right to Know
You have the right to know and request the following information relating to the Personal Information we may have collected and disclosed:
- Specific pieces of Personal Information we collected about you;
- Categories of Personal Information we collected about you;
- Categories of sources from which Personal Information is collected;
- Categories of Personal Information that we disclosed for a business purpose;
- Categories of third parties to whom Personal Information was disclosed for a business purpose; and
- The business or commercial purpose for collecting Personal
Information.
Please note, we are not required to provide you with this information more than twice in a twelve (12) month period
Your Right to Access
You have the right to access and obtain a copy of the specific pieces of Personal Information we have collected about you, upon verification of your identity.
Your Right to Correct
You have the right to request that we correct inaccurate Personal Information that we collected and maintain about you.
Your Right to Request Deletion
You have the right to request that we delete the Personal Information that we collected from you, subject to certain exceptions under the law. Once we receive and confirm your identity, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.
Your Right to Opt Out
You have the right to opt out of certain sharing of your Personal Information.
Your Right Not to Receive Discriminating Treatment
You have the right not to receive discriminatory treatment for exercising any consumer rights described in this California Notice or the CCPA.

When you exercise a right, we may ask you to provide additional Personal Information, such as your name and email, so that we can properly identify you in our dataset to track compliance with a request. We will only use Personal Information provided in a request to review and comply with the request. If you choose not to provide this information, we may not be able to respond to your request if we cannot verify your identity (or your authority to make the request for someone else). In certain circumstances, we may decline a request to exercise the rights described above.
You may designate an authorized agent to exercise your rights on your behalf in the same way you can exercise your rights.
Our Response
We will try to respond to a verifiable consumer request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email. Information provided in response to a consumer request will be provided free of charge up to twice annually.
If a request is manifestly unfounded or excessive, in particular because of its repetitive character, we may either charge a reasonable fee, taking into account the administrative costs of providing the information or communication or taking the action requested, or refuse to act on the request and notify you of the reason for refusing the request. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Your Right to Appeal
If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply. You may appeal our decision by resubmitting a request and referencing your first request and we will inform you of any action taken or not taken in response to the request and explain the reasons for our decision within sixty (60) days of receiving the request.
