Nebraska Resident Privacy Notice

This Nebraska Resident Privacy Notice (“Nebraska Notice”) provided by Premise Health Employer Solutions, LLC (“Premise Health” or “we” or “our”) supplements the information contained in our Website Privacy Policy (“Privacy Policy” or “Policy”) and our State Privacy Law Addendum (“Addendum”).
If you are a Nebraska resident that visits our Website, the information below may apply to you. This Nebraska Notice describes consumer rights under the Nebraska Data Privacy Act (“NDPA”) and explains how to exercise those rights. The NDPA protects information that is linked to or is reasonably linkable to an identified or identifiable consumer (“Personal Data”). Personal Data does not include information that is de-identified or publicly available.
The NDPA and this Nebraska Notice do not apply to Member health information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”). That information is governed by the Notice of Privacy Practices, which is available at the Privacy & Compliance Policy Center. The NDPA excludes other categories of information that we do not list here.
Any terms defined in the NDPA have the same meaning when used in this Nebraska Notice. To the extent there is any inconsistency between the Privacy Policy and this Nebraska Notice, the terms of this Nebraska Notice apply.
Personal Data We Collect, Use and/or Disclose
The categories of Personal Data we may collect, how we may use that Personal Data and the categories of third-parties to whom we may disclose that Personal Data, is included in our Privacy Policy. Specifically, we may collect, use and disclose:
- Name, email address and telephone number; and
- Internet or other electronic network activity information, such as your account name, username, IP address, online identifiers, cookies or similar data, browsing history, search history, and information regarding your interaction with our Website.
As noted in our Privacy Policy, we may collect this Personal Data directly from you or through your use of the Website, e.g., we may have collected your IP address automatically as you navigated through the Website or through the use of Automatic Tracking Technologies. Automatic Tracking Technologies are explained in the Privacy Policy.
*We do not collect or process the Personal Data of a known child. See section on Children’s Privacy in Privacy Policy.
Personal Data We May Share
We do not sell (as that term is commonly understood) Personal Data, but we may share internet or other electronic network activity information, as described above, to the following categories of third parties:
- Social media companies
- Digital advertising companies
- Analytics companies
for the purpose of internet-based advertising (targeted advertising) and to improve our services.
WE DO NOT COLLECT SENSITIVE DATA THROUGH OUR WEBSITE UNLESS IT IS SELF-REPORTED THROUGH MESSAGE CONTENT (see Privacy Policy). WE DO NOT SELL OR SHARE SENSITIVE DATA.
WE DO NOT ENGAGE IN PROFILING (AUTOMATED PROCESSING) IN FURTHERANCE OF A DECISION THAT PRODUCES A LEGAL OR SIMILARLY SIGNIFICANT EFFECT (SUCH AS DENIAL OF SERVICES) CONCERNING A CONSUMER.
Your Right to Know
You have the right to know whether we are processing your Personal Data.
Your Right to Access
You have the right to access and obtain a copy of the specific pieces of Personal Data we have collected about you, upon verification of your identity.
Your Right to Correct
You have the right to request that we correct inaccurate Personal Data that we collected and maintain about you.
Your Right to Request Deletion
You have the right to request that we delete the Personal Data that we collected from or obtained about you, subject to certain exceptions under the law. Once we receive and confirm your identity, we will delete (and direct our service providers to delete) your Personal Data from our records, unless an exception applies.
Your Right to Opt Out
You have the right to opt out of certain sharing of your Personal Data. See Decline Use of Certain Cookies section in the Privacy Policy.
Your Right Not to Receive Discriminating Treatment
You have the right not to receive discriminatory treatment for exercising any consumer rights described in this Nebraska Notice or the NDPA.
How to Exercise Your Rights
To exercise your rights to know, access, correct, delete, or opt out of targeted advertising or sale of your Personal Data, you or your authorized agent may contact us at: [email protected] or via our toll-free phone number (844) 407-7557. You may also exercise your rights to know and access by clicking Request My Information.
We are not required to provide you with information in response to a request more than twice annually.
We may ask you to provide additional Personal Data, such as your name and email, so that we can properly identify you in our dataset to track compliance with a request. We will only use Personal Data provided in a request to review and comply with the request. If you choose not to provide this information, we may not be able to respond to your request if we cannot verify your identity (or your authority to make the request for someone else). In certain circumstances, we may decline a request to exercise the rights described above.
You may designate an authorized agent to exercise your rights on your behalf.
Our Response
We will try to respond to a verifiable consumer request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email. Information provided in response to a consumer request will be provided free of charge, up to twice.
We will not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Your Right to Appeal
If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply. You may appeal our decision by resubmitting a request and referencing your first request and we will inform you of any action taken or not taken in response to the request and explain the reasons for our decision within sixty (60) days of receiving the request.
