Fitness Center Nevada Resident Privacy Notice

This Nevada Resident Privacy Notice (“Nevada Notice”) provided by the fitness centers (“Fitness Centers” or “we” or “our”) owned or operated by Premise Health Employer Solutions, LLC (“Premise Health”) supplements the information contained in our Fitness Center – Privacy Policy (“Privacy Policy” or “Policy”), which includes our policy regarding consumer health data privacy, and our Fitness Center – State Privacy Law Addendum (“Addendum”).

If you are a Nevada resident that visits the Fitness Centers, the information below may apply to you.  This Nevada Notice describes consumer rights under the Nevada Consumer Health Data Privacy Act (“NCHDPA”) and explains how to exercise those rights. The NCHDPA protects information that is linked to or is reasonably linkable to an identified or identifiable consumer and reveals their physical or mental health status (“Consumer Health Data”).  Consumer Health Data does not include information that is de-identified or publicly available or certain data about your shopping habits or interests.

The NCHDPA and this Nevada Notice do not apply to Member health information we maintain in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”).  That information is governed by the Notice of Privacy Practices, which is available at the Privacy & Compliance Policy Center.  The NCHDPA excludes other categories of information that we do not list here.

Any terms defined in the NCHDPA have the same meaning when used in this Nevada Notice.  To the extent there is any inconsistency between the Privacy Policy and this Nevada Notice, the terms of this Nevada Notice apply.

Consumer Health Data We Collect, Use and/or Disclose

The categories of Consumer Health Data we may collect, how we may use that Consumer Health Data and the categories of third parties to whom we may disclose/share that Consumer Health Data are included in our Privacy Policy.

We may also collect, use and disclose the following categories of Consumer Health Data if a Fitness Center member provides such Data to a fitness coach: (i) social, psychological, behavioral or medical interventions; and (ii) bodily functions, vital signs or symptoms.

As noted in our Privacy Policy, we may collect this Consumer Health Data directly from you or our clients (e.g., employers).  We may collect and process this Consumer Health Data through forms, questionnaires, fitness coach sessions or electronically.

Your Right to Know

You have the right to know whether we are processing your Consumer Health Data and to receive a list of all third parties with whom we have shared your consumer health data.

Your Right to Access

You have the right to access and obtain a copy of the specific pieces of Consumer Health Data we have collected about you, upon verification of your identity.

Your Right to Correct

You have the right to request that we correct inaccurate Consumer Health Data that we collected and maintain about you.

Your Right to Request Deletion

You have the right to request that we delete the Consumer Health Data that we collected from or obtained about you, subject to certain exceptions under the law.  Once we receive and confirm your identity, we will delete (and direct our service providers to delete) your Consumer Health Data from our records, unless an exception applies.

Your Right to Withdraw Consent

You have the right to withdraw your consent to the collection and sharing of your Consumer Health Data.

Your Right Not to Receive Discriminating Treatment

You have the right not to receive discriminatory treatment for exercising any consumer rights described in this Nevada Notice or the NCHDPA.

We may ask you to provide additional Personal Information, such as your name and email, so that we can properly identify you in our dataset to track compliance with a request. We will only use Personal Information provided in a request to review and comply with the request. If you choose not to provide this information, we may not be able to respond to your request if we cannot verify your identity (or your authority to make the request for someone else). In certain circumstances, we may decline a request to exercise the rights described above.

You may designate an authorized agent to exercise your rights on your behalf.

Our Response

We will try to respond to a verifiable consumer request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email.  Information provided in response to a consumer request will be provided free of charge twice each year.

We will not charge a fee to process or respond to additional requests unless it is manifestly unfounded, excessive or repetitive. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Your Right to Appeal

If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply. You may appeal our decision by resubmitting a request and referencing your first request and we will inform you of any action taken or not taken in response to the request and explain the reasons for our decision within forty-five (45) days of receiving the request.
